1. The service
HIPAA Compliant Chatbot provides a multi-tenant platform that lets healthcare practices deploy an AI-powered chat widget, manage a knowledge base, and receive inquiries and appointment requests. By creating an account you agree to these Terms on behalf of your organization.
2. HIPAA and the BAA
Before the chat widget can be activated, an authorized representative of your practice must execute our Business Associate Agreement in the dashboard. The BAA governs all handling of Protected Health Information and prevails over these Terms in any conflict concerning PHI.
3. Not medical advice
The chatbot provides administrative and informational responses only. It is not a medical device, does not provide medical advice, diagnosis, or treatment, and must not be used for emergencies. You are responsible for the accuracy of knowledge-base content you publish and for clinical oversight of your patient communications.
4. Your responsibilities
- Maintain the confidentiality of staff accounts and use appropriate roles for team members.
- Install the widget only on domains you control and have verified.
- Keep the consent banner enabled where required and configure your privacy notice.
- Comply with HIPAA and applicable state law in your use of exported data.
5. Billing
Paid plans are billed by Stripe on a subscription basis. Plan limits (conversations, AI messages, uploads, seats) are enforced automatically. Fees are non-refundable except where required by law.
6. Data retention and deletion
Default retention is 2 years for chat transcripts, 7 years for inquiries and appointment requests, and at least 6 years for audit logs. On termination we will return or destroy PHI as set out in the BAA.
7. Disclaimers and liability
The service is provided "as is". To the maximum extent permitted by law, our aggregate liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages, or for content generated by third-party AI models outside the safeguards described in our documentation.
8. Termination
You may cancel at any time from the billing portal. We may suspend or terminate accounts that violate these Terms or create security risk. Sections 2, 6, and 7 survive termination.
